The California legislature will soon take up SB 939, which breaks up existing commercial leasing contracts. The legislation is driven by State Sen. Scott Wiener (D-San Francisco) and gives commercial tenants that are impacted by loss of business during COVID-19 broad protections to alter existing leases. The one-sided proposal leaves the property owner, who is also facing challenging times, little or no remedy to fulfill his or her financial obligations.
