ICSC’s Environmental and Land Use Policy Committee held its fall meeting on October 1 in Washington, DC. The committee focused on efforts to push back on the designation of PFAS under Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) as a hazardous substance.
The designation provides a tool for private actions under CERCLA and has triggered additional release reporting requirements. It also expands enforcement authority in states that regulate CERCLA-designated hazardous substances. Over the summer, Environmental Committee members met with multiple Congressional stakeholders to express their concerns with this new designation. The Environmental Committee expects to continue this strategy in the 119th Congress.
In September, ICSC’s Economic Policy Committee held its fall virtual meeting. Members received a pre-election political briefing and discussed the economic policy agendas of each presidential campaign. The Committee also discussed updates to Corporate Transparency Act implementation and the re-proposal of Basel III.
