The California Vacancy Tax Bill, SB 789, has been defeated in the Senate Appropriations Committee and will not advance further this year.
This bill initially proposed a $5 per square foot tax on properties deemed “vacant” and also threatened a steep 75% penalty for reporting errors related to the tax.
ICSC, CBPA and other industry leaders opposed the measure, warning that SB 789 could further destabilize fragile markets, compound economic uncertainty and undermine local revenues. Under California’s Prop 8 reassessment rules, declining property values from this tax could have triggered permanent losses in funding for schools, cities and essential services.
