On February 15 the California Retail Theft Reduction Act was introduced by Assembly Speaker Robert Rivas and Representative Rick Zbur.
The bill would focus on “professional retail thieves,” creating a new crime with a maximum penalty of three years behind bars for the possession of stolen property with the intent to sell. The bill would also target aggregation, allowing the value of thefts from different retailers to be added together and prosecuted as grand theft. Online sellers would be required to maintain records to show that goods were obtained legally and large retailers would be required to report “theft data.”
Under the act, law enforcement would be able to arrest shoplifters based on a witness’ sworn statement or video footage of a crime. Courts could refer some shoplifters to alternative programs instead of jail or prison.
This bill is supported by ICSC and the California Business Properties Association (CBPA) and is designed to work in tandem with The Homelessness, Drug Addiction, and Theft Reduction Act.
