According to OMB's website, EPA submitted the proposed rule, “Definition of 'Waters of the United States' -- Recodification of Preexisting Rules,” on May 2. The usual deadline for OMB review is 90 days, but that target is non-binding and in practice the process can take more or less time. This is the first rule the Trump EPA has sent to OMB for review.
Following this announcement, ICSC met with senior EPA officials to praise this important first step in the process of rewriting this rule, which has far-reaching consequences for property owners and land developers. Furthermore, EPA has created a new WOTUS Rulemaking page on its website, which includes links to WOTUS-related documents and other background on the rulemaking process and FAQs.
