Landlords’ Redevelopment Aspirations and Ensuing Implications for Retail Tenants

From expanding existing centres to increasing density and adding residential towers, landowners continue to find ways to transform their lands to maximize value. In this session, we will discuss current redevelopment trends and the future of the shopping centre. We will also provide tips for how to safeguard landowners’ control over their lands at the lease stage, relocation rights, and what to do with existing leases that stand in the way of redevelopment plans. We’ll explore how to protect tenants against disruptions caused by redevelopment, including the value of no-builds, protected parking and maintaining access to common areas and facilities, as well as remedies for business interruption resulting from construction at the site.

Navigating the Spider’s Web of Insurance, Releases and Indemnities

This workshop will address the interplay between insurance, releases and indemnities to paint a picture of how risk typically is managed by landlords and tenants in commercial leases, with a focus on the quintessential methods of risk management and the essential requirement of clearly setting out each party’s insurance obligations. 

The speakers will focus on the essential terms of insurance that landlords and tenants should expect of one another, the role of insurance advisors/risk managers in commercial lease negotiations and what it means to obtain blanket insurance or to self-insure against certain risks. The workshop will also cover why sophisticated contracting parties utilize and look to releases and indemnities and what each should and should not cover.
