Privacy Policy

Your privacy is important to us. To better protect your privacy, we provide this Privacy Policy (“Policy”) explaining our information practices and the choices you can make about the way your information is collected and used. All capitalized terms not defined in this Policy shall have the meanings assigned to them in the Terms of Service for use of the Website/App.

This Policy describes the types of personal data (defined below) that we may collect from you or that you may provide when you visit our Website (https://www.icsc.com)/App, including if you email us or send us other electronic messages, and our practices for collecting, using, maintaining, protecting, and disclosing that information. 

This Policy does not apply to third-party websites, products, or services, even if our Website or App links to them or vice versa. You should review the privacy notices of those third parties to understand their practices regarding your personal data. ICSC is not responsible for the privacy practices or content of those other websites.

Please read this Policy carefully to understand our practices regarding your information and how we will treat it. This Policy may change from time to time (see Changes to Our Privacy Policy) so please check the Policy periodically for updates. If there are any material changes to this Policy, we will notify you as required by applicable law.

Children Under the Age of 16.  Our Website/App is not intended for children under the age of 16. We do not knowingly collect personal data from children under 16. If you are under the age of 16, do not use or provide any information on our Website/App, including providing any information about yourself to us. If we learn we have collected or received personal data from a child under the age of 16 without parental consent, we will delete that information. If you believe we have any information from a child under the age of 16, please contact us (see How to Contact Us below).

The Information We Collect and How We Collect It

We collect information about you in many ways and some of the information we collect may include personal data. As used in this Policy, “personal data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identifiable individual. Personal data includes “personal information” as that term is defined in applicable privacy laws  that can be used to identify you. Personal data does not include publicly available information from government records or deidentified or aggregated consumer information.

Information Collected From You. We collect personal data that you provide to us when applying to become a member, registering for an event, or requesting information from us. This information may include your  name,  address, e-mail address, corporate affiliation or other biographical information that you may provide to us when you complete your membership or event registration profile, photograph, telephone number, fax number, credit card information, any special accommodations (dietary, religious, health/disability) and other personal data provided to us by you when registering for an event or to be considered by us when providing our services, and may also include information about your interests in and use of various products, programs, and services.

If you contact us, we may collect records and copies of your correspondence (including email addresses). You may also provide information to be published or displayed on public areas of the Website/App or transmitted to other members or entities (“Contributions”) and such Contributions, which may include your property listing information, your corporate affiliation, your resume and other employment information if you use our Talent HQ platform to find a job, are done at your own risk as we cannot control the actions of other users of the Website with whom you may choose to share Contributions.

The Website/App also allows you to submit information about other people. For example, you might submit a person's mailing and e-mail address to enroll them in an ICSC event, or if you order publications online and want them sent directly to the recipient, you might submit the recipient's name and address. ICSC expects that you have received the appropriate consent, according to applicable privacy laws, before transferring any personal data to us. In addition, when ICSC members forward ICSC event invitations to third parties, we may collect certain personal data from those third parties, such as their email address.

Information We Collect Automatically.  As you navigate through and interact with our Website/ App, we may use automatic data collection technologies to collect certain information about you. For example, if you use our App, location information may be collected, which may be used to provide directions for how to get to certain locations during our events. Additionally, we use cookies (a tiny file stored on your computer’s browser) to tell us about your device, browsing actions, and patterns including details of your visits to our Website/App, whether you have or have not opened an email from us, and information about your device and internet connection, including your IP address or device identifier, operating system, and browser type. Information Collected From Our Service Providers. We may also collect personal data via our service providers, including those providing hosting, analytics, cloud services, customer and technical support, email services, and other services. For example, we may collect personal data if you use the chatbot on our Website, which is provided by our third-party service provider TurnoutNow. 

Information Collected From Other Third Parties.  We may collect information from third parties that we may use to market our product and services to you, including business and marketing partners, ad network providers, and advertisers.   Some content or applications, including advertisements, on our Website/App are served by third parties, including advertisers, content providers, your mobile device manufacturer/ mobile service provider, and application providers. These third parties may use tracking technologies, including cookies, alone or in conjunction with other tracking technologies, to collect information about you when you use our Website/App. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

Cookies and Other Tracking Technologies.

We use cookies and similar tracking technologies and analytics services to track activity on and gauge the effectiveness of our Website/App. Cookies are files with a small amount of data which may include unique identifiers. Cookies are sent to your browser from a website or mobile application and stored on your device. Other tracking technologies are also used such as beacons, tags, and scripts to collect and track information and to improve and analyze our Website/Appe. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Website/App.

Cookies on our Website/App generally fall into the following categories:

  • Strictly Necessary. We may use cookies that we consider are strictly necessary to allow you to use and access our Website/App, including cookies required to prevent fraudulent activity, and improve security.
  • Performance/Analytics. We may use cookies that are useful to assess the performance of our Website/App, including as part of our analytic practices or otherwise to improve our Website/App.
  • Functionality. We may use cookies that are required to offer you enhanced functionality when accessing our Website/App, including identifying you when you sign in to our website or keeping track of your specified preferences, including in terms of the presentation of content on our Website/App.
  • Targeting or Advertising. We may use cookies to deliver content, including advertisements, relevant to your interests on our Website/App based on how you interact with advertisements or content. We do not use your information for targeted advertising on third-party platforms.

Analytics Information

We may use Google Analytics or other service providers for analytics services. These analytics services may use cookies to help us analyze how users use the Service. Information generated by these services (e.g., your IP address and other usage information) may be transmitted to and stored by Google Analytics and other service providers on servers in the U.S. (or elsewhere) and these service providers may use this information for purposes such as evaluating your use of the Services, compiling statistic reports on the Service’s activity, and providing other services relating to Services activity and other Internet usage. Advertising Industry Resources

You can understand which entities have currently enabled cookies for your browser or mobile device and how to opt out of some of those cookies by accessing the Network Advertising Initiative’s website or the Digital Advertising Alliance’s website. Please note these opt-out mechanisms are specific to the device or browser on which they are exercised. Therefore, you will need to opt out on every browser and device that you use.

At this time, we do not honor “do-not-track” signals from a website browser. However, you may refuse or delete cookies. Please refer to your browser Help instructions to learn more about cookies and other technologies and how to manage their use. If you elect to refuse or delete cookies, you will need to repeat this process if you use another mobile device, computer, or change browsers. If you choose to decline cookies, some of the functionality of a website or App may be impaired. You may also choose whether or not to allow the App to collect and use real-time information about your device’s location. If you block the use of location information, some parts of the App may become inaccessible or not function properly.

How We Use the Information We Collect

ICSC may use the information you provide about yourself for the following purposes:

  • To present our Website/App and its contents to you.
  • To fulfill your requests for our products, programs, and services, to respond to your inquiries about our offerings, and to offer you other products, programs or services that we believe may be of interest to you. We also may use this information to communicate with you, such as to notify you when we make changes to our subscriber agreements, to fulfill an online order for ICSC products, or to contact you about issues regarding your membership.
  • We may include your name, title, corporate affiliation, biography information and photograph as provided to ICSC in connection with any ICSC event attendance lists or other business purposes of ICSC.
  • To share your property listing information as provided to ICSC in connection with commercial property listings or related business purposes.
  • To complete your membership profile for our Member Directory.
  • To register you for an event.
  • We use the information that you provide about others to enable us to send them the relevant information which you have requested for them. From time to time, we also may use this information to offer our products, programs, or services to them.
  • To monitor and analyze trends, usage, and activities
  • To fulfill any other purpose for which you provide us personal data or for which you consent.
  • The information we collect in connection with our Networking Platform and online discussion forums is used to facilitate participation in the forums and, from time to time, to offer you products, programs, or services.
  • If you choose to submit User Content for publication, we may publish your name and other information you have provided to us.
  • To improve the design and content of our products, programs and services and to enable us to provide a more tailored interface for individual Users.
  • We may receive information about you from other sources, including from third parties. We may combine this information with other information provided by you which helps us to update and expand our records, identify potential new members, and tailor our advertising and marketing communications to you.
  • For internal business purposes, including general business administration.
  • To help detect and prevent fraud and maintain the safety, security, and integrity of our Website/App, products and services, and databases.
  • To evaluate or conduct a merger, asset transaction, or other business combination, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of all or some of our assets (“transaction”), whether as an ongoing concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by us about our Website users, members, or customers is among the assets being transferred, which may occur prior to consummation of such transaction.

Disclosure of Your Information

We may disclose aggregated information about users, and information that does not identify an individual, without restriction. We may disclose personal data that we collect as described in this Policy:

  • To contractors and service providers to provide services on our behalf, such as email services; analytics; hosting; marketing; customer and technical support; and other services. For example, if you use our chatbot, the information provided may be recorded and stored by ICSC and our third-party provider, TurnoutNow, on our behalf. 
  • To other members who can search for you and contact you if you choose to participate in our Directory. You may elect certain options to hide portions of your membership information from being accessible on the Directory.
  • To third-party platform providers, including advertising, social media, and analytics companies, who assist us in serving advertising regarding our services to others who may be interested. We also partner with third parties who use cookies to serve interest-based advertising and content on their respective third-party platforms that may be based on your preferences, location, and/or interests.
  • To facilitate ICSC member connections on our Networking Platform.
  • To share commercial property listing information with other members and services, which may include sharing your name, member identification, email address, and membership status to enable access to external listing services.
  • To other event participants, for example, we may include your name, title, corporate affiliation, biography information and photograph as provided to ICSC in connection with any ICSC event attendance lists or other business purposes of ICSC.
  • On occasion, ICSC may disclose non-financial personal data of Users who are U.S. residents to companies whose practices are not covered by this privacy notice (e.g., marketers, magazine publishers, retailers, participatory databases, and non-profit organizations) that want to market products or services to you. Any User wishing to opt-out of the distribution of their personal data can email a request to the ICSC at web@icsc.com. Please include in the subject line: “PII Opt-Out.”
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal data:

  • To comply with any court order, law, or legal process, including to respond to any law enforcement, government, or regulatory request.
  • To enforce or apply our Terms of Service and any other agreement, including for billing and collection purposes.
  • To detect, prevent, or mitigate fraud or security or technical issues.
  • To protect against imminent harm to the rights, property, or safety of ICSC, our members, or the public as required or permitted by law.
  • In corporate transactions, we may share your information with a potential buyer or other successor to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as party of bankruptcy, liquidation, or similar proceeding, in which personal data held by us about our consumers is among the assets transferred; and
  • As otherwise described to you when collecting your personal data.

ICSC will not use or transfer personal data provided to us in ways unrelated to the ones described above.

Employees, agents and contractors of ICSC who have access to personal data are required to protect this information in a manner that is consistent with this Policy by, for example, not using the information for any purpose other than to carry out the services they are performing for ICSC. ICSC members and non-members who have access to personal data of members and other individuals through the use of the Website/App are also required to protect this information in a manner that is consistent with this Policy, and are required to use such information strictly for business related purposes.

Our Commitment to Security

We have put in place appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website/App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to safeguard against unauthorized disclosures of information, we cannot assure you that personal data that we collect will never be disclosed in a manner that is inconsistent with this Policy or as otherwise permitted by law. Please see section 5 of the Terms of Service.

Changes to Our Privacy Policy

We may update this Policy from time to time. We will notify you of material changes consistent with applicable law. We will post the updated policy on our Website/App so you are always aware of what information we collect, how we use it, and the circumstances, if any, on how we disclose it. The date this Policy was last revised is identified at the top of the page. You are responsible for ensuring that we have an up-to-date active and deliverable email address for you. We recommend periodically visiting our Website/App and this Policy to check for any changes.  Your continued use of our Website/App following the posting of changes constitutes acceptance of such changes.   Where required by applicable law, we will also seek your consent to any material changes that affect how we use your information.
